Terms & Conditions

These Terms explain how Kromaic works with its clients. They were last updated in October 2026.

About Kromaic

Kromaic is a trading name of Blake James Marlon Packshaw, a sole trader based in London, United Kingdom. In these Terms, "Kromaic", "we", "us" and "our" refer to Blake James Marlon Packshaw trading as Kromaic. You can contact us by email at hello@kromaic.com.

Kromaic works with both businesses and individual consumers. Nothing in these Terms removes, restricts or overrides any rights you have by law, including your statutory rights as a consumer.

About these Terms

These Terms explain, in general, how Kromaic works with clients. Before any project begins, we will agree the specific requirements of that project with you in writing.

Our services

Kromaic provides website design and development services. This may include:

  • New website design and development
  • Redesigns of existing websites
  • Website refreshes
  • Website structure and content support
  • Website launch and configuration
  • Integration of appropriate third-party services

Ongoing website maintenance is not part of our standard service. Future redevelopment, changes or additional work may be agreed separately.

Individual project agreements

Each project will have its own written quote, proposal or project agreement. Where applicable, it will set out:

  • The project scope
  • The deliverables
  • The price
  • The payment schedule
  • The timeline
  • The number of included revision rounds
  • Any project-specific requirements
  • Any project-specific third-party services

If there is a conflict between these general Terms and a specific written project agreement, the written project agreement takes precedence for that project.

Payment

Our standard payment structure is that 50% of the agreed project price is payable before work begins, and the remaining 50% is payable after completion. Your individual project agreement may set out the exact payment dates and the circumstances in which each payment is due.

Cancellation

If you cancel a project before it is completed, the amount payable will be determined by reference to the agreed project scope, the deliverables and the work actually completed at the date of cancellation. Where appropriate, your project agreement may divide the project into agreed deliverables or stages, each with a corresponding value.

Any amount you have already paid will be considered alongside the value of the work actually completed. Any refund due to you, or any further amount payable, will reflect the work completed, the payments already made and your rights under applicable law. The upfront payment is not automatically non-refundable, there is no fixed cancellation charge, and you will not automatically be required to pay the full remaining balance.

If Kromaic cancels a project where you have not breached the agreement or been at fault, the financial consequences will be dealt with fairly in accordance with your project agreement and applicable law.

Nothing in this section affects any statutory cancellation or refund rights you may have as a consumer.

Revisions and changes

Each project will specify the number of included revision rounds. Additional revisions, or work outside the agreed scope, may be charged separately only where the additional work and its cost have been communicated to you and agreed by you before that work is carried out.

Your responsibilities

You are responsible for providing the text, images, branding, information and other materials reasonably required to complete your website. You confirm that you have the necessary rights or permissions to use any materials you provide to us. Delays in providing required content, information or feedback may affect the project timeline.

Domains and hosting

We may help you purchase, configure or connect a domain and hosting. Where possible, your domain and hosting will be held in your own account and under your ownership.

You are responsible for ongoing domain, hosting and third-party service costs unless your project agreement expressly states otherwise. As ongoing maintenance is not part of our standard service, Kromaic does not manage your domain or hosting account on an ongoing basis.

Third-party services

We may integrate third-party services into your website, such as booking platforms, forms, payment systems, hosting services, domain services and other external tools. Where appropriate, you will hold the relevant third-party account and pay the provider directly.

Third-party services are subject to the relevant provider's own terms, pricing, availability and privacy policies. Kromaic does not guarantee the availability, pricing, functionality or performance of third-party services.

Website ownership and intellectual property

Once you have paid Kromaic in full for the agreed project, you own the bespoke website and design work specifically created for you.

This does not include Kromaic's pre-existing tools, systems, templates, processes and general know-how, which remain owned by Kromaic. It also does not include third-party materials such as software, frameworks, fonts, plugins, images and services. Kromaic cannot transfer ownership of third-party materials it does not own, and those materials remain subject to their own licences and terms.

No guarantees of results

Purchasing a website does not guarantee any particular commercial result. Kromaic does not guarantee Google or other search-engine rankings or placement, website traffic, the number of enquiries or leads, sales, conversions, revenue or business performance. Nor do we guarantee website uptime, the availability of third-party services or results from third-party platforms.

Liability

Kromaic will provide its services with reasonable skill and care. Nothing in these Terms excludes or restricts any liability that cannot legally be excluded or restricted, or affects your statutory rights.

Privacy

Information about how we handle personal data is set out in our separate Privacy Policy.

Governing Law and Jurisdiction

These Terms and any agreement between Kromaic and a client shall be governed by the laws of England and Wales.

Subject to any rights that cannot legally be excluded or restricted, the courts of England and Wales shall have jurisdiction over disputes arising from or relating to these Terms or the services provided by Kromaic.
